These terms apply to the Western Sydney Software website and enquiries made through it. Paid consultancy work is governed by separate terms agreed for that engagement. A separate section preserves terms relevant to the shelved Buzz product.

Who operates this website
Western Sydney Software is the business name of Western Sydney Software Solutions Pty Ltd (ABN 75 661 896 117, ACN 661 896 117). In these terms, “we”, “us” and “our” refer to that company.
Using this website
You may use this website to learn about our services and contact us about a business problem or possible project. You must not interfere with the website, attempt unauthorised access, introduce malicious code, misuse its content, or use it unlawfully.
Website content may be changed or removed, and the website may sometimes be unavailable. Links to third-party websites are provided for context or convenience. Those websites are controlled by their operators and have their own terms and privacy practices.
Enquiries and consultancy engagements
Sending an enquiry does not appoint Western Sydney Software, create a consultancy engagement or require either party to proceed. We may ask questions or discuss possible approaches before deciding whether to offer work.
Any paid consultancy or development work is subject to a separate proposal, statement of work, agreement or other terms accepted by both parties. Those separately agreed terms take priority for that engagement.
Do not send confidential information unless you are authorised to share it. If material is especially sensitive, ask us about an appropriate way to provide it before sending it.
Website information
Website content is general information about the kinds of problems and projects we may work on. It is not technical, legal, financial or other professional advice for a particular situation. Project examples illustrate prior work but do not promise the same approach or outcome for another project.
Intellectual property
Unless stated otherwise, the website content, branding, graphics and software are owned by or licensed to Western Sydney Software. You may view the website for your own lawful purposes, but must not copy, publish, sell, reverse engineer or commercially exploit its content without permission or another legal right to do so.
Governing law
These website terms are governed by the laws of New South Wales, Australia.
Legacy product terms: Buzz
Buzz was a digital paging product operated by Western Sydney Software. It has been shelved and is no longer actively developed. These legacy terms record conditions that applied when Buzz was operating; they do not represent that the product remains supported or available.
Accounts and use
Buzz was provided “as is” and “as available”. Registered users were required to be at least 18, able to enter a binding contract and to provide accurate and complete account information. Subject to those terms, Western Sydney Software granted a limited, non-exclusive, non-assignable and non-transferable licence to use Buzz for its intended purpose.
Users were not permitted to reproduce, publish, sell, exploit or reverse engineer Buzz or its content; remove proprietary notices; impersonate others; scrape or data-mine the product; interfere with its operation; introduce malicious code; disguise the source of transmitted information; infringe another person’s rights; or use Buzz unlawfully.
Merchants, orders and refunds
Merchants using Buzz were separate third parties, not employees or representatives of Western Sydney Software. A merchant was responsible for the goods or services it offered, its fulfilment of an order and its own refund policy, subject to applicable law. Questions or disputes about a merchant’s goods, services or refunds were to be directed to that merchant.
Communications and external services
Buzz used email, SMS and push notifications for matters such as order updates, receipts and service communications. SMS delivery has since been disabled. Buzz also used or linked to third-party services that were controlled by their own operators and subject to their terms.
Content and availability
Buzz content, trademarks, logos and software were owned by or licensed to Western Sydney Software unless otherwise stated. The original terms allowed Western Sydney Software to maintain, change, restrict or discontinue Buzz and recognised that the product might be unavailable because of maintenance, technical problems or other interruptions. Buzz has now been shelved.
Responsibility and liability
The original Buzz terms stated that merchants, rather than Western Sydney Software, were responsible for the quality and provision of their goods and services. They also limited Western Sydney Software’s liability for use of or inability to use Buzz, merchant conduct, unavailable products or information, unauthorised access to data, interruptions and related losses, with total liability capped at the amount paid to access Buzz. These provisions remain subject to any rights and remedies that cannot lawfully be excluded or limited.
Other legacy provisions
The original Buzz terms were governed by the laws of New South Wales and stated that its courts had exclusive jurisdiction. They restricted a user from assigning rights or licences under the terms, allowed Western Sydney Software to assign them, and stated that a failure to assert a right was not a waiver of that right.
